INFORMATION REGARDING THE PROTECTION OF YOUR PERSONAL DATA

PEKEL Construction and Investment Anonim Şirketi (“Company”) is under the protection of the Company. Personal data is processed by the Company within the scope of this Clarification Text in accordance with the Law on the Protection of Personal Data No. 6698 (“KVKK”) and its secondary regulations and other relevant legislation regarding the protection of personal data.

Pursuant to KVKK, personal data means any information that makes your identity specific or identifiable. Your personal data processed by the Company, the purposes for which they are processed, the recipient groups to which they may be transferred, the method of collection, the legal reason, and your rights regarding such personal data are set out below. 

A- OUR ONLINE VISITORS

A.I. WHAT IS YOUR PERSONAL DATA PROCESSED?

If you visit our website, your following personal data may be processed;

 

  • Identity Information: Name and surname,
  • Contact Information: Phone number, e-mail address, address;
  • Transaction Security Information: IP address information, website login and logout information.

 

A.II. PURPOSES OF PROCESSING YOUR PERSONAL DATA

Your personal data may be processed in accordance with the relevant legislation for the following purposes;

Your personal data, within the scope of the provisions of KVKK regarding the transfer of personal data, of this Clarification Text A.II. heading To the extent required by the purposes set out below; it may be shared with judicial authorities or law enforcement agencies within the country if requested in accordance with the relevant legislation.

A.IV. LEGAL REASON AND COLLECTION METHOD OF PROCESSING PERSONAL DATA

Your personal data is processed by automatic or non-automatic means during your visit to our website from electronic media for the purpose stated above, based on the compliance reasons specified in the provisions of articles 5 and 8 of the Law and listed below.

 

  • Being foreseen in the legislation to which the Company is subject, 
  • The necessity of data processing for the Company to fulfill its legal obligations,

  • The necessity of data processing for the establishment, exercise or protection of a right,

B.I. WHAT IS YOUR PERSONAL DATA PROCESSED? 

If you visit our Company, name, surname, e-mail, phone number, visitor entry-exit record information, profession information, camera records, and if you have a request for wireless internet access; Your IP address, internet entry-exit log records, password and username information are processed.

 

B.II. PURPOSES OF PROCESSING YOUR PERSONAL DATA

If you visit our Company; Your personal data is processed for the purposes of ensuring in-company security, executing the ethical reporting process, keeping a door pass report, providing information to authorized authorities in case of crime or illegality, and ensuring the security of the guest wireless internet network.

 

B.III. TRANSFER OF PROCESSED PERSONAL DATA

Your personal data, within the scope of the provisions of KVKK regarding the transfer of personal data, of this Clarification Text B.II. heading To the extent required by the purposes set out below, it may be shared with authorized institutions and organizations, law enforcement agencies, and the service provider company if requested.

B.IV. LEGAL REASON AND COLLECTION METHOD OF PROCESSING PERSONAL DATA

Your personal data is collected, stored, and processed physically, in writing, verbally, or via security cameras when you visit the Company campus, within the scope of the purposes stated above, based on the compliance reasons specified in the provisions of articles 5 and 8 of the KVKK and listed below.

 

  • In the event of actual impossibility, the necessity of data processing for the protection of the life or bodily integrity of the person himself or someone else, who is unable to explain his consent or whose consent is not legally valid,
  • Provided that it does not harm the fundamental rights and freedoms of the relevant person, data processing is mandatory for the legitimate interests of the data controller.

Within the scope of your relationship with the Company, your following personal data is processed;

  • Contact Information: Address information, e-mail, phone number,
  • Other Information: Request information, message information

 

C.II. PURPOSES OF PROCESSING YOUR PERSONAL DATA

Your personal data obtained within the scope of your relationship with the Company is processed for the purposes set out below.

  • Execution of communication activities,
  • Execution of the quotation process for products,
  • Fulfillment of promotion and marketing activities for products,
  • Execution of analysis studies for target audience determination,
  • Fulfillment of legal obligations arising from legislation,
  • Checking the credit limit for the term sales process.

 

C.III. TRANSFER OF YOUR PERSONAL DATA

Your personal data may be shared with business partners and, upon request, authorized persons, institutions, and organizations to the extent required by the purposes set out under Heading C.II of this Clarification Text within the scope of the provisions of KVKK regarding the transfer of personal data domestically and abroad.

Your personal data is collected orally, in writing, or electronically during the establishment of your legal relationship with our Company and during the continuation of said relationship, provided that it is obtained from you, our business partners, and legal authorities, via the website, various contracts, e-mail tools, and through written or oral communication channels made with our Company. Your personal data collected in this direction is processed based on the legal compliance reasons specified in Articles 5 and 8 of the KVKK and set out below.

 

  • Obtaining explicit consent,
  • Provided that it is directly related to the establishment or performance of a contract, it is necessary to process personal data belonging to the parties of the contract

Within the scope of your relationship with the Company, your following personal data is processed;

  • Your Contact Information: Address information, e-mail, telephone number, registered electronic mail address (KEP), 
  • Your Legal Transaction Information: Information in the lawsuit file, information in correspondence with judicial authorities,
  • Your Financial Information: Bank, account and card information, invoice and debt information, credit and risk information, 
  • Your Customer Transaction Information: Order information, request information, invoice, promissory note, check information,

 

D.II. PURPOSES OF PROCESSING YOUR PERSONAL DATA

Your personal data obtained within the scope of your relationship with the Company is processed for the purposes set out below.

  • Execution of after-sales support services for products,
  • Execution of the custom-made product preparation process,
  • Execution of communication activities,
  • Execution of accounting processes,
  • Management of requests and complaints,
  • Making informational announcements to customers,

D. III. TRANSFER OF PROCESSED PERSONAL DATA

Your personal data may be shared with business partners and, upon request, authorized persons, institutions, and organizations to the extent required by the purposes set out under To the extent required by the purposes set out under heading D.II; it can be transferred to authorized institutions and organizations domestically, our business partners, our suppliers and their authorized persons, and abroad to our business partners, our affiliates and subsidiaries, our suppliers, and third parties.

Your personal data collected in this direction is processed based on the legal compliance reasons specified in Articles 5, 8, and 9 of the KVKK and set out below.

  • Being explicitly stipulated in the legislation to which our Company is subject, especially the Turkish Commercial Code, 
  • Provided that it is directly related to the establishment or performance of a contract, it is necessary to process the personal data of the parties to the contract, 
  • Being mandatory for the fulfillment of the legal obligation,
  • The necessity of data processing for the establishment, exercise or protection of a right,
  • Provided that it does not harm the fundamental rights and freedoms of the relevant person, data processing is mandatory for the legitimate interests of the data controller.

This Clarification Text shall be valid as of the date it is published by the Company. The Company may make changes to this Clarification Text whenever necessary. The changes to be made by the Company will be published on pekelyatirim.com becomes valid upon publication at .
